1. Agreement to terms
These Terms of Service apply to use of the PixelNestTech website and, where incorporated by reference, access to PixelNestTech SaaS services. Customer-specific Order Forms or services agreements may contain additional or different terms and will control to the extent of a conflict.
2. Service description
PixelNestTech provides payment technology software, including orchestration, provider integration, multi-currency transaction models, event handling and related operational tooling. Specific functionality depends on the contracted deployment and connected providers.
3. No representation as payment provider
Unless expressly stated in an applicable agreement and supported by the required authorizations, PixelNestTech does not represent itself as the bank, card network, payment institution or other regulated payment provider that actually holds or moves customer funds.
4. Customer responsibilities
Customers are responsible for lawful use of the service, provider relationships, merchant or platform onboarding requirements, end-user terms, data submitted to the service and the security of their own systems and credentials.
5. Credentials and access
Access credentials must be protected and used only by authorized personnel or systems. Customers must promptly address suspected credential compromise and should not place server-side secrets in public or client-side code.
6. Third-party providers
Connected payment providers and other third-party services operate under their own terms, availability and technical requirements. PixelNestTech does not control third-party service outages, policy changes or commercial decisions.
7. Fees and commercial terms
Fees, service levels, implementation scope and payment terms are set out in the applicable commercial agreement or Order Form rather than on this public website.
8. Intellectual property
PixelNestTech and its licensors retain rights in the platform, software, documentation, branding and related materials. Customers retain rights in their own data, applications and content, subject to the rights needed for service delivery.
9. Suspension and termination
Access may be restricted where reasonably necessary to address security incidents, unlawful use, material contractual breach or risk to the service or connected providers. Contractual termination rights are governed by the applicable customer agreement.
10. Liability framework
Any warranties, exclusions, indemnities and liability caps applicable to a customer deployment are set out in the governing commercial agreement. Nothing on this public website expands those commitments.
11. Governing terms
The governing law, dispute process and venue for a customer relationship are specified in the applicable services agreement or Order Form.
12. Changes
We may update these website terms from time to time. Material changes to contracted services remain subject to the applicable customer agreement.
